An FCM is a federally regulated intermediary, similar to a traditional stockbrokerage but for derivatives, that can accept customer orders and hold customer funds for futures, options, and swaps trades.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The registration itself doesn&#8217;t turn either company into a prediction market operator. Exchanges like Kalshi operate as CFTC-designated contract markets, a different and more involved registration. What FCM status would give Fliff and Onyx is the ability to sit between customers and those exchanges directly, accepting funds and facilitating trades rather than just referring customers elsewhere the way a more limited introducing broker registration allows. Onyx has already been operating in the space through Onyx Predictions, an NFA-registered introducing broker; the new Onyx Markets filing would let it bring more of that function in-house.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why Fliff, Specifically, Has Reason to Move<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The timing lines up with real pressure on Fliff&#8217;s existing business. The Illinois Gaming Board issued cease-and-desist letters to 65 sweepstakes operators in February, including Fliff, VGW&#8217;s brands, Stake.us, Pulsz, Modo, and High 5 Casino, arguing they were operating as illegal gambling businesses under state law regardless of their sweepstakes legal theory. Since then, the list of states blocking Fliff Cash redemption specifically, as opposed to the free-to-play Fliff Coins side, has grown to 17, including California, New York, Colorado, and Illinois itself, alongside a full operational ban in Washington and Idaho. More than a dozen states have now restricted or banned sweepstakes-style gaming in some form since late 2025.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Moving toward federally regulated event contracts would put Fliff on the same legal footing prediction markets have been asserting in court: that CFTC oversight preempts state gambling law entirely, the same argument Kalshi and Novig are currently making in active lawsuits against a growing list of states.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Part of a Broader Pattern<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Fliff and Onyx join a lengthening list of operators with sweepstakes roots testing different routes into prediction markets. ProphetX and Novig both applied for designated contract market status in late 2025, with the CFTC approving them within a week of each other in June. Betr took a different route, acquiring NFA-registered introducing broker Ascent Capital Management in May.
